Technically, FOIA is a federal law that covers only federal agencies.
However, most states, and many cities, have somewhat similar laws ("Sunshine Laws," would be one of the common names for such laws...although almost everyone uses the FOIA acronym for information requests) that are meant to open up state and local public entities to public scrutiny. The city of Newark's city council can go into Executive Session to discuss things privately and avoid FOIA requests, but those items have to meet some pretty strict standards (personnel issues, legal challenges, contract discussions (although those contracts should be made public after implementation), etc.).

501(c)(3) entities, which includes UD, receive two federal tax privileges: donors can deduct their contributions and the 501(c)(3) doesn't have to pay tax on the contributions received. The primary requirement to maintain this privilege is to file the annual Form 990 and ensure that employees and board members and vendors do not receive outsized compensation. My personal view is that the feds should make these entities subject to FOIA as well.

Just a silly question. Are college athletes still considered amateurs? Not only are they paid to play but some make more money that some professionals.
Arch Manning gets 6.8 million... Carson Beck gets 4.3 million... Jeremiah Smith gets 4,2 million. Even if a college player get $500 a month is he an amateur? Is there such a thing as amateurs any more. I like NCAA football better than NFL but both are professional nowadays.
Teams with deep pockets will always field the top teams. And, yes, on top of that some schools are cheating with NIL payments. Many teams are at a sever disadvantage when it comes to recruiting and retaining players. I really miss the old days where a guy would be recruited, coached up and become part of a team. I like watching that cycle in a kids career. Now a recruit ask how much money will I make and will I be a starter? If they pile up enough stats they will transfer somewhere to make more money.
I don't mind athletes sharing in the profit they help make with ticket sales but when is it enough?

We are already seeing that happen with basketball. Players went to the G-League are now going back to college. Schools should consider signing players to multi year contracts. Also, remember when Academic Progress Assessments were required to be reported and a minimum level of achievement was required? QB Darian Mensah signed a 2 year contract with Duke for $8 million. Played one year, placed his name in the portal in January. Duke sued and then settled allowing Mensah to transfer to Miami. Settlement conditions were not released.
Contracts appear to be easily broken.

Has NIL been bad for Delaware overall? The football team exceeded expectations but every other team that gets a sliver seems to have had or is having quite the “off year”?

I have a feeling that NIL will be kinda a push for programs like UD. Sure there will be kids who transfer out for more money and or playing time. I do think we will get a crack at some recruits who would have been scooped up to secure depth at SEC, ACC, Big10 schools who now fall through the cracks so to speak. Mid and lower tier high school recruits don't get quite the same level of attention any more so there is probably a bigger pool than years past for programs like UD to draw from. (I've read multiple articles on just this how many good recruits are relogated to lower tier schools since so many schools are focused less on player development and relying more on Free agency AKA transfers). Tradition still Matters
For UD to be successful long run identifying young up and coming coaches and getting them here will be a key to consistent success going forward. Coaches are going to get scooped up that may matter more than the transfers who leave in the long run,
